NOTICE FOR CHEEKTOWAGA-SLOAN UNION

FREE SCHOOL DISTRICT

NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the Cheektowaga-Sloan Union Free School District, Erie County, New York will be held in the Irma Czubaj Board Room at said district on Tuesday, May 11, 2010 at 7:00 pm at which all interested persons will be heard.

NOTICE IS HEREBY GIVEN, that the voting shall be held on Tuesday May 18, 2010 at the John F. Kennedy High School, 305 Cayuga Creek Road, Cheektowaga, NY 14227, County of Erie, State of New York at which time the polls will be open between the hours of 12 noon and 9:00 p.m., prevailing time to vote by machine upon the following items:

1. To adopt the annual budget of the Cheektowaga-Sloan Union Free School District for the fiscal year 2010-2011 and to authorize the requisite portion thereof to be raised by a tax on the taxable property of the District.

2. To elect two (2) members to the Board, two for a five (5) year term commencing July 1, 2010 and expiring on June 30, 2015, currently held by Debra Smith. and Ceil Grzybek.

AND FURTHER NOTICE IS HEREBY GIVEN that a copy of the statement of the amount of money which will be required to fund the School District’s budget for 2010-2011 exclusive of public monies, may be obtained by any resident of the District during business hours beginning Tuesday, May 4, 2010 to May 18, 2010 at the Office of the Director of Finance and Administrative Services, 166 Halstead Ave., Sloan, NY.

AND FURTHER NOTICE IS HEREBY GIVEN that petitions nominating candidates for the office of members of the Board of Education shall be filed with the Clerk of said School District at the Clerk’s office in the Administrative Offices of the School District, 166 Halstead Ave., Sloan, NY not later than April 19, 2010, between 8:00 a.m. and 5:00 p.m. Each petition shall be directed to the Clerk of the District. Education Law Section 2018(a) states nominating petitions must be signed by at least 25 qualified district voters or 2% of the number of voters who voted in the previous annual election of the members of the board of education, which every is greater.

The petition must state the name and residence of the candidate, and name and address of the signatures, and shall describe the specific vacancy for which the candidate is nominated.

AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote at said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older, (3) resident within the School District for a period of thirty (30) days next preceding the annual vote and election, and (4) is not otherwise prohibited from voting pursuant to the Election Law. The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law Section 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the School District also requires all persons offering to vote to provide their signature and printed name and address.

AND FURTHER NOTICE IS HEREBY GIVEN that applications for absentee ballots for the purposes of voting on all propositions and election of two (2) Board of Education members, may be applied for at the office of the District Clerk. A list of all persons to whom absentee ballots have been issued will be available in the office of the District Clerk, on each of five (5) business days prior to the vote and at the polling place on the day of the vote.

AND FURTHER NOTICE IS HEREBY GIVEN that pursuant to a rule adopted by the Board in accordance with 2035 and 2008 of the Education Law, copies of which are available at the office of the District Clerk any referenda or propositions to amend the budget, otherwise to be submitted for voting at said election, must be filed with the Clerk of the Board of Education on or before April 19, 2010 at 5:00 p.m. prevailing time; must be typed or printed in English, must be directed to the Clerk of the School District . Education Law Section 2018(a) states nominating petitions must be signed by at least 25 qualified district voters or 2% of the number of voters who voted in the previous annual election of the members of the board of education, which every is greater. DISTRICT PUBLIC HEARING

AND VOTE

NOTICE IS HEREBY GIVEN that the Annual School District Vote of Cheektowaga Maryvale Union Free School District (the "District") of the Town of Cheektowaga, Erie County, New York will be held Tuesday, May 18, 2010 from 12:00 Noon Eastern Daylight Saving Time to 9:00 P.M. Eastern Daylight Saving Time at the High School Gymnasium of the Cheektowaga-Maryvale High School (9-10) Building, 1050 Maryvale Drive, Cheektowaga, New York for the purpose of voting on a proposition concerning expenditures for the fiscal year 2010-11, and for the transaction of such other business as is authorized by law.

TAKE FURTHER NOTICE, that the election of one (1) member of the Board of Education also shall be held at the above time and place to fill one (1) position on the Board for a five-year term commencing on July 1, 2010 and terminating on June 30, 2015 to fill the vacancy created by the expiration on June 30, 2010 of the term of member Kristen R. Finn. Said Kristen R. Finn may be a candidate.

TAKE FURTHER NOTICE, that the election of one (1) member of the Board of Education also shall be held at the above time and place to fill one (1) position on the Board for the remainder of a five-year term commencing on July 1, 2009 and terminating on June 30, 2014 to fill the vacancy created by the resignation of member Steven W. Cahoon, and which is currently being served by appointee Nicholas R. Giammarise who will hold the position until the date of the election pursuant to Education Law Section 1709[17]. Said Nicholas R. Giammarise may be a candidate.

TAKE FURTHER NOTICE that all candidates for the office of a member of the Board of Education shall be nominated by petition. Each petition shall be directed to the Clerk of the District, shall be signed by at least twenty-five (25) qualified voters of the District, shall state the residence of each signer, shall state the name and residence of the candidate, and shall describe the specific vacancy on the Board of Education for which the candidate is nominated, which description shall include at least the length of term of office, and the name of the last incumbent, if any. Each petition shall be filed in the office of the Clerk of the District between the hours of 9:00 A.M. and 5:00 P.M. Eastern Daylight Saving Time not later than April 19, 2010.

TAKE FURTHER NOTICE that voting machines will be used to record the vote on the budget and on the election of two (2) members of the Board of Education.

TAKE FURTHER NOTICE that applications for absentee ballots for the Annual District Vote may be obtained from the office of the Clerk of the District in the District=s Administrative Offices, located in the Samuel R. Bennett Administration Building, 1050 Maryvale Drive, Cheektowaga, New York. Completed applications must be received by the District Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. Absentee ballots must be received by the District Clerk not later than 5:00 P.M. on May 18, 2010. A list of persons to whom absentee ballots have been issued will be available for inspection in the office of the District Clerk during regular office hours on each of the five (5) business days before the election, and at the polling place on the day of the election. Any qualified voter present in the polling place may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefore known to the Inspector of Election before the close of the polls.

TAKE FURTHER NOTICE that voting on the budget and all propositions shall consist of voting on the following proposition and any other propositions authorized to be voted upon by law.

PROPOSITION NO. 1

2010-11 Budget

Shall the following resolution be adopted, to wit:

RESOLVED, that the budget for the Cheektowaga-Maryvale Union Free School District (the "District") for the fiscal year commencing July 1, 2010 and ending June 30, 2011 as presented by the Board of Education, is hereby approved and adopted and the required funds therefor are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.

TAKE FURTHER NOTICE that the Board of Education of this District has adopted Rules for the Use of Voting Machines and the Submission of Questions or Propositions to be placed thereon and printed copies for general distribution in the District are available at the District=s Administrative Offices located in the Samuel R. Bennett Administration Building, 1050 Maryvale Drive, Cheektowaga, New York.

TAKE FURTHER NOTICE that the Board of Education of this District will have prepared and completed a detailed statement in writing of the amount of money which will be required for the ensuing fiscal year, 2010-11, for school purposes, specifying the several purposes and amount of each. The amount of each purpose estimated necessary for payments to Boards of Cooperative Educational Services shall be shown in full, with no deduction of estimated state aid. The amount of State Aid provided and its percentage relationship to the total expenditures shall also be shown. Said statement will be available, upon request, to any resident of this District during the hours of 9:00 A.M. to 3:00 P.M. Eastern Daylight Saving Time from April 27, 2010 to May 18, 2010 exclusive of May 1, May 2, May 8, May 9, May 15, and May 16, 2010 at each of the public school houses of the District.

Sale of Unneeded Real Property

Shall the following resolution be adopted, to wit:

RESOLVED, that the Board of Education of the Cheektowaga-Maryvale Union Free School District (the ADistrict@) is hereby authorized to sell the District=s former school building and a portion of the property upon which it sits, located at 777 Maryvale Drive (a portion of SBL# 91.15-14-3.1) (as such building and portion of property are more fully described and depicted in materials available for inspection in the Office of the District Clerk) for an amount not less than $750,000 and upon such other terms as the Board may direct, and that the proceeds from any such sale shall be credited to the funds under control and administration of the Board of Education.
