NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN that sealed proposals will be received and considered by the Town Board of the Town of Cheektowaga, County of Erie, State of New York, on the 22nd day of February, 2012 at 11:00 a.m. in the Town Hall in the Town of Cheektowaga, New York, for the furnishing and Installation of Trees along Town Highways within the Town of Cheektowaga.

Information for bidders and specifications may be obtained from the Town Clerk at her office in said Town Hall.

Proposals shall be submitted in a sealed envelope, plainly marked on the outside "Bid for Furnishing and Installation of Trees along Town Highways" and submitted to the Town Clerk prior to bid opening.

Any bid not delivered in person shall be mailed to the Office of the Town Clerk, Town of Cheektowaga, Town Hall, Broadway and Union Road, Cheektowaga, New York 14227.

The right to reject any and all bids, to waive any informalities in, or to make an award to other than the low bidder, should it be deemed to be in the best interest of the Town of Cheektowaga and in accordance with the law, are herewith reserved.

Each proposal must be accompanied by a certified check for a sum equal to five percent (5%) of the amount of the bid, payable to the order of the Town of Cheektowaga, New York, or bond with sufficient sureties to be approved by the attorney for the Town of Cheektowaga, New York, in a sum equal to five percent (5%) of the amount of the bid, conditioned that, if his proposal is accepted, he will enter into a contract for the same and that he will execute such further security as may be required for the faithful performance of the contract.

No bidder may withdraw his bid within thirty (30) days after the date set for the opening thereof, but may withdraw same any time prior to the scheduled date for the opening of bids.

The successful bidder will be required to furnish a Performance Bond acceptable to the Owner, in an amount equal to the contract award.

Attention of the bidders is further called to Section 103-d of the General Municipal Law which requires a Bidder's Certificate of Non-Collusion. Such certificate is part of the bid or proposal form and unless complied with, such bid will not be accepted.

The Town of Cheektowaga is an exempt organization under the Tax Law and is exempt from payment of sales and compensating use taxes of the State of New York and cities and counties of the State on all materials which are to be incorporated into the project, pursuant to the provisions of the contract. These taxes are not to be included in the bid.

Decision of Parks Ordinance

WHEREAS, the Town of Cheektowaga previously adopted a Parks Ordinance (Chapter 174 of the Code of the Town of Cheektowaga) with amendments thereto, and Rules and Regulations governing Cheektowaga Town Parks which apply to all public parks and public park approaches owned by the Town of Cheektowaga, and

WHEREAS, the Parks Ordinance which permitted the walking of dogs on leashes in the various town parks, excluding John C. Stiglmeier Park and Cheektowaga Town Park, subject to certain restrictions, expired on December 31, 2011, and

WHEREAS, the Director of the Facilities Department and the Parks, Facilities & Wildlife Management Committee have recommended that dogs on leashes should continue to be permitted in the various Town parks, excluding John C. Stiglmeier Parks and Cheektowaga Town Park, and

WHEREAS, this Town Board desires to amend the Parks Ordinance to permit same, and

WHEREAS, in accordance with the provisions of Section 130 of the Town Law of the State of New York, a public hearing was held on the 17th day of January, 2012 at 6:45 P.M. at a meeting of the Town Board at the Cheektowaga Town Hall, 3301 Broadway, Cheektowaga, New York 14227, at which hearing all parties in interest and citizens had an opportunity to be heard as to whether Chapter 174 of the Code of the Town of Cheektowaga (“Parks Ordinance”) shall be amended as provided in the attached Notice of Hearing, and BE IT FURTHER

WHEREAS, it is in the public interest to adopt the aforesaid proposed amendment to the Parks Ordinance, NOW, THEREFORE, BE IT

RESOLVED, that the Parks Ordinance (Chapter 174) of the Code of the Town of Cheektowaga) be and hereby is amended as follows:

§174-8. Domestic animals prohibited from parks and park approaches, shall be amended to read as follows:

§ 174-8. Domestic animals in parks and park approaches.

A. Dogs shall be permitted in town parks, except for John C. Stiglmeier Park and Cheektowaga Town Park, subject to the following conditions/limitations:

(1) Dogs must be restrained/hand-controlled by leash (no longer than six feet in length);

(2) No person walking or in charge of any dog in said area(s) shall cause, suffer or allow such dog to soil, defecate on or commit any nuisance in said area (unless said person picks up and properly disposes of the feces in an appropriate container); and

(3) Dogs shall not be permitted on any park lands designated for sport fields and/or in areas immediately adjacent to playground structures.

B. Dogs shall be permitted in the area designated as the Alexander Walking Path (described as follows: the park area/walking trail area on the east side of Scajaquada Creek west and north of the Alexander Community Center, but not including any area east of the parking lot for the Cheektowaga Recreation Center/Ice Rink building), subject to the conditions and limitations contained in subsections (A)(1), (A)(2), and (A)(3) of this section.

RESOLVED, that a copy of this resolution be entered in the minutes of the meeting of the Town Board of the Town of Cheektowaga held on the 6th day of February, 2012, and that a certified copy hereof be published in the CHEEKTOWAGA BEE, the official Town newspaper, and BE IT FURTHER

RESOLVED, that this amendment shall become effective after publishing and posting as required by statute.

NOTICE IS HEREBY GIVEN that the Board of Fire Commissioners of the Pine Hill Fire District No. 5 in the Town of Cheektowaga, Erie County, New York, at a meeting held on the 7 day of February 2012 duly adopted the following Resolution, subject to a permissive referendum.

RESOLUTION #1

A resolution authorizing the Board of Fire Commissioners of the fire district, Town of Cheektowaga, Erie County, New York, to purchase Twenty (20) new 2007 NFPA compliant Self-contained Breathing Apparatus with spare cylinder and masks at a cost up to $115,000 with the funds to come from the Equipment Reserve fund. Be it resolved, by the Board of Fire Commissioners of the Pine Hill Fire District in the town of Cheektowaga, Erie County, New York.

This resolution is adopted February 7, 2012 subject to a permissive referendum.
