APPROVE REZONING OF

1694 WALDEN AVENUE

WHEREAS, Charles J. Basil petitioned for a rezoning from CM-General Commercial District to MS-Motor Services District for property owned by Walden Avenue Distributors LLC and located at 1694 Walden Avenue, Cheektowaga, New York (S.B.L. No. 102.03-2-11.22), which property is described in the attached legal description, for the conversion of an existing warehouse to an automotive detail shop and a parts/records storage facility ancillary to Basil Ford Automotive Dealership at 1540 Walden Avenue, and

WHEREAS, a public hearing on such petition was held before this Town Board on the 6th day of February, 2012 at 6:45 P.M., after publication and service of the notices required by the provisions of the Code of the Town of Cheektowaga (“Zoning Law”), and the Town Law; and all interested parties were given an opportunity to be heard at such hearing, and

WHEREAS, the Cheektowaga Planning Board has reviewed such application and has recommended approval thereof, and

WHEREAS, this Town Board previously issued a Negative Declaration under SEQRA and the Town Environmental Impact Review Ordinance for this rezoning, NOW, THEREFORE, BE IT

RESOLVED, that the application of Charles J. Basil for the rezoning from CM - General Commercial District to MS - Motor Services District of the property described in the attached legal description be and the same is hereby approved subject to the following conditions:

1. Any future additions to the site plan must be resubmitted to the Town Board to determine that the addition is substantially in agreement with the intent of this rezoning;

2. Rezoning is for the use of the property solely for a automotive detail shop and parts/records storage facility ancillary to the automotive facility located at 1540 Walden Avenue.

LEGAL DESCRIPTION

ALL THAT TRACT OR PARCEL OF LAND, situated in the Town of Cheektowaga, County of Erie and State of New York, being part of Lot Number 24, Township 11, Range 7 of the Holland Land Company's Survey, bounded and described as follows:

BEGINNING at a point in the east line of lands conveyed to the Polish National Catholic Cathedral of the Holy Mother of the Rosary by deed recorded in the Erie County Clerk's Office in Liber 5085 of Deeds at Page 368, which point is distance 344.67 feet from the intersection of said east line of the lands so conveyed to the said Polish National Catholic Cathedral of the Holy Mother of the Rosary and the north line of the Walden Avenue Extension: thence northerly and along said easterly line of lands so conveyed to the said Polish National Catholic Cathedral of the Holy Mother of the Rosary, 287.63 feet to a point; said point being also the intersection of said east line of lands conveyed to the said Polish National Catholic Cathedral of the Holy Mother of the Rosary and the southerly lines of lands conveyed to Abbott Laboratories by deed recorded in the Erie County Clerk's Office in Liber 6207 of Deeds at Page 482; thence westerly and along the said southerly line of lands so conveyed to the said Abbott Laboratories, 157.18 feet to a point on the east line of a private roadway; thence southerly and at an interior angle of 90°, 287.63 feet to a point on the east line of the said private roadway; thence easterly 159.10 feet to the point of beginning.

TOGETHER with an easement and right of access over a private roadway as set forth in an Easement Agreement recorded in Erie County Clerk's Office on August 31, 1981 in Liber 9057 of Deeds page 590, and subsequently modified by Agreement recorded in Erie County Clerk's Office on March 11, 1982 in Liber 9107 of Deeds page 373.
